O direito à informação aplicado às relações de trabalho

Abstract

O presente estudo visa analisar as diversas possibilidades de aplicação do Direito à Informação às relações de trabalho. Para isso, a pesquisa é realizada através da análise do panorama da sociedade atual, da aplicação do Direito à Informação a partir de cada fonte do Direito do Trabalho, notoriamente daquelas elencadas no artigo 8º da Consolidação das Leis do Trabalho, bem como da verificação de recentes legislações que envolvem o Direito à Informação, através de revisão bibliográfica qualitativa. Neste contexto são apresentados alguns conceitos acerca do momento da sociedade atual, do enquadramento do Direito à Informação na legislação em geral e algumas concepções acerca das fontes do Direito do Trabalho. Em seguida, são apresentadas as possíveis contribuições do Direito à Informação às relações de trabalho, sob à ótica do artigo 8º da Consolidação das Leis do Trabalho. Ao final, o Direito à Informação é analisado como base de recentes legislações, novas regras e direitos. Pode ser verificado que se vive a chamada Sociedade da Informação, onde garantir o acesso à Informação, significa garantir o próprio exercício da liberdade enquanto direito fundamental e universal. E, deste modo, o Direito à Informação na esfera particular garante a liberdade individual e, no plano coletivo, uma sociedade fraterna e o bem-estar social. Com isto, restaram identificadas possíveis formas de aplicação do Direito à Informação às relações de trabalho que podem contribuir para que estas relações sejam mais transparentes e, também, para a prevenção de litígios. Ainda, restou identificado que o Direito à Informação tem ganhado mais espaço no ordenamento jurídico brasileiro, pois está sendo utilizado como fundamento de novas legislações e direitos.

This study aims to analyze the various possibilities of applying the Right to Information to work relationships. For this, the research is carried out by analyzing the panorama of the current society, the application of the Right to Information from each source of Labor Law, notoriously those listed in article 8 of the Consolidation of Labor Laws, as well as the verification of recent legislation involving the Right to Information, through a qualitative bibliographical review. In this context are presented some concepts about the current society, the framework of the Right to Information in the legislation in general and some conceptions about the sources of Labor Law. Then, the possible contributions of the Right to Information to labor relationships are presented, under the perspective of article 8 of the Consolidation of Labor Laws. At last, the Right to Information is analyzed as the basis of the recent legislations, new rules and rights. It can be verified that we live in what we call the information society, where guaranteeing access to information means guaranteeing the very exercise of freedom as a fundamental and universal right. And, in this way, the Right to Information in the particular sphere guarantees individual freedom and, at the collective level, a fraternal society and social welfare. With this, there were identified possible ways of applying the Right to Information to labor relations that can contribute to make these relationships more transparent and also to the prevention of disputes. Also, it was identified that the Right to Information has gained more space in the Brazilian legal system, since it is being used as a basis for new legislation and rights.
