A transferência do potencial construtivo dos imóveis inventariados e tombados : um instrumento de preservação em Porto Alegre?

Abstract

A Transferência do Potencial Construtivo (TPC), ou também chamada de Transferência do Direito de Construir (TDC), é o instrumento urbanístico brasileiro por meio do qual o poder público municipal, conforme regramento próprio, pode autorizar o proprietário de um imóvel urbano a alienar, ou a exercer em outro local, o direito básico de construir não utilizado em seu terreno. A partir de 1987, Porto Alegre inicia a utilização da TPC como forma de indenização na desapropriação dos imóveis tombados pelo patrimônio histórico. Mais tarde, o instrumento da TPC foi apresentado como uma proposta para o uso do solo no Estatuto da Cidade, Lei Federal nº 10.257/2001. Este trabalho propõe um estudo sobre a preservação dos bens do patrimônio histórico e cultural da cidade de Porto Alegre, a partir da efetividade do uso da TPC. Entende-se haver uma lacuna nos estudos relacionados à aplicação, monitoramento e às interfaces dos diferentes instrumentos urbanísticos que compõem o planejamento urbano. O objetivo é entender os processos e as modalidades da TPC dos imóveis inventariados e tombados adotados pela municipalidade no período de 1979 a 2024. Nesse sentido, o estudo propõe uma revisão histórica de literatura e da legislação da implementação da TPC, a partir do papel do Estado no ordenamento urbano e nas políticas públicas. Os dados e as informações deste trabalho contribuem para a avaliação, reavaliação ou revisão de como o planejamento urbano intervém na preservação dos bens históricos e culturais das cidades.

The “Transferência de Potencial Construtivo” (TPC), or also called Transfer of the Right to Build (TDC), is the Brazilian urban planning instrument, through which the municipal public authority, according to its own rules, can authorize the owner of an urban property to alienate, or exercise in another location, the basic right to build unused on their land. From 1987 onwards, Porto Alegre began using the TPC as a form of compensation in the expropriation of properties listed as historical heritage. Later, the TPC instrument was presented as a land use proposal in the City Statute, Federal Law nº 10,257/2001. This work proposes a study on the preservation of historical and cultural heritage assets in the city of Porto Alegre, based on the effectiveness of the use of TPC. It is understood that there is a gap in studies related to the application, monitoring and interfaces of the different urban instruments that make up urban planning. The objective is to understand the processes and modalities of the TPC of inventoried and listed properties adopted by the municipality in the period from 1979 to 2024. In this sense, the study proposes a historical review of literature and legislation on the implementation of the TPC, based on the role of State in urban planning and public policies. The data and information in this work contribute to the evaluation, re evaluation or review of how urban planning intervenes in the preservation of historical and cultural assets in cities.
