Trabalho em plataformas digitais a regulação possível diante da ordem econômica na Constituição Federal

Abstract

A indagação que a presente tese expressa é sobre haver possibilidade de regulação do trabalho humano realizado por intermédio de plataformas digitais, frente aos princípios da ordem econômica na Constituição Federal. Se a resposta é afirmativa, a contribuição que se busca dar é sobre o modo como se deve dar essa regulação - por meio de edição de lei sobre a matéria. Para tanto, o método utilizado é o hipotético dedutivo, partindo da questão fática que envolve o problema, ou seja, o surgimento das plataformas digitais, bem como de uma nova forma de economia, denominada economia colaborativa, determinando a sua extensão e limitação, na busca da construção de um modelo teórico aplicável. O trabalho se encontra dividido em três partes. Na primeira, apresenta-se o surgimento das plataformas digitais e da economia colaborativa, relacionando-as com o trabalho humano. Na segunda, trabalha-se o arcabouço teórico dos princípios constitucionais da ordem econômica. Na terceira, verificam-se as iniciativas concretas, judiciais e legislativas no Brasil, mas também no Reino Unido e no Estado da Califórnia (escolhidos pela relevância de suas decisões), para buscar uma solução para os conflitos oriundos dessa nova relação de trabalho. A partir daí, encaminham-se as considerações finais, apresentando alternativas viáveis de regulação do trabalho prestado por intermédio das plataformas digitais com a edição de lei sobre a matéria.

The subject of this thesis is the possibility of regulating human work on digital platforms, in face of the principles of economic order in the Federal Constitution. If the answer is affirmative, the contribution sought to be made is on how this regulation should be given - through the enactment of a law on the matter. For that, the method used is the hypothetical-deductive, starting from the factual issue that involves the problem, that is, the emergence of digital platforms, as well as a new form of economy, called collaborative economy, determining its extension and limitation, in the search for the construction of an applicable theoretical model. The work is divided into three parts. The first presents the emergence of digital platforms, the collaborative economy, relating them to human work. In the second, the theoretical framework of the constitutional principles of the economic order is worked on. In the third, there are concrete - judicial and legislative - initiatives in Brazil, but also in the United Kingdom and the State of California (chosen by the relevance of their decisions), to seek a solution to the conflicts arising from this new working relationship. From there, the final considerations are forwarded, presenting viable alternatives for regulating the work provided through digital platforms with the enactment of a law on the matter.
