A justiça nos contratos coletivos

Abstract

Como contrato que é, o contrato coletivo não pode ser examinado de forma isolada, apenas a partir dos ramos da ciência do direito em que reiteradamente incide. O presente trabalho tem por objetivo o estudo dos contratos coletivos, inseridos na lógica de reconstrução dos contratos como categoria jurídica e à luz de uma concepção específica de justiça. A pretensão é situar os contratos coletivos como manifestação de justiça comutativa, compondo, junto com a regra estatal, um todo normativo harmônico. Esta visão possibilita o enfrentamento de duas das questões mais tormentosas sobre o tema, quais sejam a dos seus limites materiais e a da escolha de seus métodos interpretativos.

Collective bargaining, being a contract in nature, cannot be examined in an isolated form, by only covering the parts of the law it specifically influences. The objective of this research work is to study the subject of collective bargaining inserted within the logic of contract review activities as their own legal matter category, and under the light of a specific concept of justice. The intention here is to position collective bargaining as a manifestation of commutative justice, which comprises, together with state regulation, a harmonious group of concepts. This vision allows the collision of two of the most conflicting questions around this subject: where do its material limits are, and the choice of its interpretative methods.
