Educação e direitos humanos : garantias, violações e socioeducação

Abstract

Este trabalho tem como objetivo compreender como ocorre a vinculação do conceito de educação com o conceito de direitos humanos a partir de sua visão crítica, identificando como são descritos os contextos de violação ao direito à educação nos trabalhos acadêmicos de ensino superior. Essa busca ocorre a partir de um recorte na educação nos contextos de socioeducação, com medidas de meio fechado e medidas de meio aberto. Os pontos levantados neste trabalho são os direitos humanos, a educação, a socioeducação e justiça juvenil, tendo como procedimento metodológico a pesquisa bibliográfica. A coleta dos materiais de análise ocorreu através de uma busca bibliográfica na plataforma online da Biblioteca Digital de Teses e Dissertações (BDTD). Ao todo foram selecionados 14 trabalhos, entre dissertações e teses, com datas de publicação delimitadas em um período de dez anos, variando entre os anos de 2010 e 2020. Todas as produções selecionadas foram escritas por mulheres, e majoritariamente são da área da educação. O referencial teórico é dividido em duas partes: conceituação dos Direitos Humanos a partir de uma perspectiva histórico-crítica, utilizando a literatura de FLORES (2008) e; Apresentação do panorama brasileiro socioeducativo, a partir de legislações e estudos voltados para o caráter educativo das medidas socioeducativas. A análise dos dados está dividida em três grandes dimensões: Educação como um direito; Vulnerabilidade Social e Violência e; Culturas Escolares e Relação da Família com a Educação. Os trabalhos analisados trouxeram uma perspectiva ampla a respeito da inserção desses adolescentes na sociedade. A insuficiente presença dos direitos humanos interligados à educação dentro das universidades, a partir das produções realizadas nesses espaços, demonstra a necessidade de uma abertura para a expansão desse conceito.

This work it aims to understand how is the link between the concept of education and the concept of human rights from your critical point of view from its critical point of view, identifying how the contexts of violation of the right to education are described in academic works of higher education. This search occurs from a cut in education in the contexts of socio-education with measures of closed medium and measures of open medium. The points raised in this work are human rights, education, socio-education and juvenile justice, using bibliographical research as a methodological procedure. The collection of the analysis materials occurred through a bibliographic search in the online platform of the Digital Library of Theses and Dissertations (DLTD). In all, 14 papers were selected, including dissertations and theses, with publication dates delimited in a period of ten years, ranging from 2010 to 2020. All the selected productions were written by women, and mostly are in the area of education. The theoretical framework is divided into two parts: conceptualization of Human Rights from a historical-critical perspective, using the literature of FLORES (2008) and; Presentation of the Brazilian socio-educational panorama, based on legislation and studies focused on the educational character of socio-educational measures. Data analysis is divided into three main dimensions: Education as a right; Social Vulnerability and Violence and; School Cultures and the Family's Relationship with Education. The works analyzed brought a broad perspective regarding the insertion of these adolescents im society. The insufficient presence of human rights interconnected to education within universities, from the productions carried out in these spaces, demonstrates the need for an opening for the expansion of this concept.
