Deferência judicial e regulação econômica : análise da autoridade das agências reguladoras e do papel do judiciário

Abstract

Este trabalho analisa a relação entre a legitimidade das agências reguladoras, sua autonomia técnica e o papel do Poder Judiciário na revisão de suas decisões. A pesquisa examina: (i) os fundamentos da legitimidade estatal e as transformações do Estado contemporâneo com a consolidação do modelo de Estado Regulador; (ii) a atuação das agências reguladoras no Brasil, sua autonomia, os desafios enfrentados e os mecanismos de controle que orientam sua atuação; e (iii) a interação entre o Poder Judiciário e as agências reguladoras, com destaque para os limites e possibilidades da deferência judicial. O estudo busca compreender como a supervisão judicial pode garantir a proteção do interesse público sem comprometer a expertise técnica das agências, promovendo transparência, responsabilidade e eficiência administrativa em um cenário de crescente complexidade regulatória.

This research examines the relationship between the legitimacy of regulatory agencies, their technical autonomy, and the role of the Judiciary in reviewing their decisions. The study explores: (i) the foundations of state legitimacy and the transformations of the modern State with the establishment of the Regulatory State model; (ii) the functioning of regulatory agencies in Brazil, focusing on their autonomy, the challenges they face, and the control mechanisms that govern their operations; and (iii) the interaction between the judiciary and regulatory agencies, emphasizing the boundaries and potential of judicial deference. The analysis seeks to understand how judicial oversight can safeguard the public interest without undermining the technical expertise of regulatory agencies, while promoting transparency, accountability, and administrative efficiency in an increasingly complex regulatory landscape.
