Desigualdades de acesso à justiça : investigações sobre as possibilidades de um subcampo na pesquisa sociológica

Abstract

Nosso trabalho se propõe a investigar sobre a existência de um subcampo de pesquisa sociológica a respeito das desigualdades de acesso ao sistema judiciário no Brasil. Nossa base de pesquisa é a investigação de artigos a partir de um duplo filtro inserido no sistema de periódicos da CAPES. Como hipótese principal aventamos que a existência de fatos sociais sobre a desigualdade de acesso à justiça não se traduzem no estabelecimento de sum subcampo de pesquisa. Traçamos um referencial teórico sobre as pesquisas em estratificação e desigualdades sociais passando de um contexto mais geral para o histórico de estudos no Brasil. Metodologicamente utilizamos como palavras de pesquisa os termos “desigualdade” e “justiça”, a partir dos resultados obtidos fomos efetuando analises sobre suas relações com o tema ou com possibilidades de usos plurais para os termos. Obtivemos resultados no sentido de confirmar nossa hipótese e salientar usos com siginificados diversos dos termos. A partir dessas situações avaliamos possibilidades de crescimento do subcampo e da concepção de problemas sociológicos pertinentes.

This work aims to investigate the existence of a sociological research subfield regarding inequalities to access the justice system in Brazil. The base of our research is the articles' investigation using a double filter in the CAPES journal system. As the main hypothesis, we suggest that the existence of social facts regarding the inequality of access to justice does not imply the establishment of a research subfield. We traced a theoretical reference about the research on stratification and social inequalities, from a broader view to the history of studies in Brazil. For the method, we have used the terms “inequality” and “justice” as search words. Then, the results of these searches were analyzed considering their relation with the topic, or possibilities of plural uses for the terms. We had results endorsing the hypothesis and pointing out usages of the terms with diverse meanings. Based on the results, we evaluate that there are possibilities of growth for the subfield, and the realization of pertinent social problems.
